• ALL DISPUTES  WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING  CLAIMS IN A CLASS ACTION FORMAT. 

• THESE OFFICIAL RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZES AWARDED.

1. Description of Promotion 

Welcome to the Tourney Shuffle’Em Sweepstakes (the “Promotion”) where participants enter for a chance to win a share of the prize pool for FanDuel Sportsbook site credit (“Sportsbook Site Credit”) or FanDuel Daily Fantasy Sports site credit (“DFS Site Credit”) (together with Sportsbook Site Credit, “FanDuel Site Credit”), by selecting a virtual card with the correct picks of the final four (4) teams in the 2024 Men’s Basketball NCAA Tournament.

The Promotion is sponsored by Betfair Interactive US, LLC (“BIU”), located at 6701 Center Drive West, Suite 800, Los  Angeles, CA 90045 and FanDuel Inc., located at 300 Park Ave South, 14th Floor, New York, NY 10010 (“FanDuel” and  together with BIU, “Sponsor”). The terms “you” or “your” mean the person to whom a Prize (defined below) is  issued to upon satisfaction of the official rules set forth in this Promotion. Participation in the Promotion is  expressly conditioned upon acceptance of and compliance with all of these Promotion “Official Rules.” Promotion participants may be required to sign paperwork issued by Sponsor. 

2. Promotion Period 

The Promotion will begin on or around 10:00 a.m. Eastern Time (“ET”) on March 18, 2024 and all entries must be received by the start of the first 2024 Men’s Basketball NCAA Tournament game on March 21, 2024 (the “Promotion Period”). 

3. Eligibility 

The Promotion is open to individuals who enter with a Sportsbook Account (as defined herein) and who, at the time of entry, are at least twenty-one (21) years of age and are physically present in New Jersey, New York, Massachusetts. Pennsylvania, Illinois, Indiana, Iowa, West Virginia, Colorado, Tennessee, Virginia, Michigan, Vermont, Ohio, Arizona, Connecticut, Kansas, Kentucky, North Carolina, Louisiana (excluding the following parishes: Caldwell,  Catahoula, Franklin, Jackson, LaSalle, Sabine, Union, West Carroll and Winn) or Wyoming. The Promotion is also open to individuals who enter with a DFS Account (as defined below) who are at least eighteen (18) years of age or older, nineteen (19) years of age or older if in Alabama, and twenty one (21) years of age or older if in Massachusetts, Arizona, Louisiana or Iowa who comply with FanDuel’s terms of use for free entry contests. If your Social Security number is associated with another Sportsbook Account or DFS Account (as defined below) database, you may only earn one Prize (defined below) with respect to all such Sportsbook or DFS Accounts (as defined below) participating in this Promotion. Employees, officers and directors of Sponsor, their parent companies, and each of their  respective affiliates, subsidiaries, cable/satellite affiliates, advertising and promotion agencies, prize providers, retailers, distributors (collectively, the “Promotion Entities”), and  each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household  (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Prize (as defined below). For purposes of this Promotion, “immediate family members” are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and “those living in the same household” shall mean people who share the same residence at least three (3) months a year, whether legally related or not. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, Sponsor or one of its affiliates or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions which Sponsor or its affiliates or gaming license partners operate are not eligible to participate in the Promotion or receive a Prize (as defined below).

4. Action Required 

To participate in the Promotion, entrants must have a Sportsbook Account or DFS Account (each defined below) per Section 6 below. Then, during the Promotion Period, prior to the start of the day’s first 2024 Men’s Basketball NCAA Tournament game on March 21, 2024 (“Lock Time”), log in to your Sportsbook Account or DFS Account (each defined below) and select the “Tourney Shuffle’Em Contest” (found in the “Free to Play” section), where you will be given a virtual card. The virtual card will contain four (4) random, pre-populated outcomes predicting the final four (4) teams of the 2024 Men’s Basketball NCAA Tournament. Users can keep their virtual card with the selections of outcomes or they can choose to shuffle their virtual card for another virtual card with new selections of outcomes (each, a “Shuffle”), up to a maximum of twenty (20) times during the Promotion Period, before the Lock Time. If a user exhausts all twenty (20) Shuffles, they cannot make any further Shuffles in this Promotion. To win a share of the total prize pool for FanDuel Site Credit, all of the outcomes displayed on the virtual card you select must occur. 

Limit one (1) virtual card per person in this Promotion (each, an “Entry”). Any Entry submitted after already submitting an Entry for the same contest or after the contest Lock Time will not qualify as an eligible Entry. No purchase or deposit is necessary in order to submit an Entry. Subsequent attempts made by the same individual to submit multiple Entries by using multiple or false contact information, accounts or otherwise may result in the entrant being disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Promotion at Sponsor’s sole and absolute discretion. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. All materials submitted become the physical property of Sponsor and will not be returned. In the event of a dispute as to the identity of any participant who submits an Entry, the Entry will be deemed submitted by the registered account holder of the email or other account from which it was sent but only if such person is otherwise eligible. The “registered account holder” is the person assigned an email address or username by the entity responsible for assigning it (e.g., FanDuel, Yahoo). Winners may be required to show proof of being the registered account holder. If a dispute cannot be resolved to the Sponsor’s satisfaction, the Entry will be deemed ineligible. Sponsor’s designated database clock will be the official timekeeper for this Promotion. Those who do not follow all of the instructions, provide the required information in their virtual card, or abide by these Official Rules or other instructions of Sponsor may be disqualified. All entrants submitting materials/content as part of the Promotion will be non-exclusively licensing (with the unlimited right to sublicense) to Promotion Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof. Entrants represent and warrant that the materials submitted will not infringe or violate any right whatsoever, including, without limitation, any personal rights (e.g., defamation, privacy, false light, moral right, etc.) or any property rights (e.g., copyright, trademark, right to ideas, etc.) of any person or entity and the use thereof will result in no third party liability or obligations. The Promotion Entities may run multiple campaigns, contests, sweepstakes or other promotions simultaneously. Entry into one (1) campaign, contest or sweepstakes does not constitute entry into any other. 

5. Claiming Promotion Prizes/Odds

Subject to verification of eligibility and compliance with the terms of these Official Rules, entrants who have all outcomes on their virtual card occur and receive a perfect score (each, a “Winner”) will receive an even share of the fifty thousand dollars ($50,000) pool in FanDuel Site Credit (each share, a “Prize”). The Prize will be credited to a Winner as either Sportsbook Site Credit or DFS Site Credit, depending on whether the Winner entered this Promotion via FanDuel Sportsbook or FanDuel Daily Fantasy Sports. If no one receives a perfect score, then no Prizes will be awarded. The approximate retail value (“ARV”) of all Prizes awarded in this Promotion is fifty thousand dollars ($50,000). Odds of winning depend on the total number of persons participating and an individual’s knowledge and ability to correctly predict winning teams participating in the 2024 Men’s Basketball NCAA Tournament games. 

The Prize will be automatically credited to a Winner’s Sportsbook Account or DFS Account (each defined below) that you used to enter into the Promotion, within seventy-two (72) hours of the completion of the Promotion Period. Prize recipients will be solely responsible for all federal, state and local taxes, and for any other fees or costs associated with the Prize received, regardless of whether the Prize, in whole or in part, is used. The Prize value may be reported for tax purposes as required by law. All Prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and Prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide a Winner with their Prize, Sponsor may elect to provide Winners with the approximate value of such item in cash or award an alternate Prize of comparable or greater value. All Prizes are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). The ARV of the Prizes is based on available information provided to Sponsor and the value of any Prize awarded to a Winner may be reported for tax purposes as required by law. The Winners may be required to provide Sponsor with a valid Social Security number before the Prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of Winners. Unclaimed Prizes will be forfeited. Prizes, if legitimately claimed, will be awarded. The Promotion Entities are not responsible for and will not replace any lost, mutilated or stolen Prizes or any Prize that is undeliverable or does not reach a Winner because of an incorrect or changed address. If a Winner does not accept or use the entire Prize, the unaccepted or unused part of the Prize will be forfeited, and the Promotion Entities will have no further obligation with respect to that Prize or portion of the Prize. The Promotion Entities are not responsible for, and Winners will not receive the difference, in any, between the actual value of the Prizes at the time of award and the stated ARV in these Official Rules or in any Promotion-related correspondence or material. Limit of one (1) Prize per person in this Promotion.

6. Registration Procedures 

To qualify for the Promotion, eligible individuals must have an active FanDuel Sportsbook member account (“Sportsbook  Account”) or an active FanDuel Daily Fantasy Sports member account (“DFS Account”). Creating a Sportsbook Account  at https://sportsbook.fanduel.com or a DFS Account at https://www.fanduel.com/join is free. By submitting your  information and creating a Sportsbook Account or a DFS Account, however, participants will be required to agree to the FanDuel Terms of Use (https://www.fanduel.com/terms) and Privacy Policy (https://www.fanduel.com/privacy). If you do not agree to FanDuel’s Terms of Use and Privacy Policy, you cannot create a Sportsbook Account or a DFS Account, or participate in this Promotion.  

7. Limitations on Participation 

In addition to the eligibility requirements in Section 3 above, BIU and FanDuel reserve the right to refuse or otherwise restrict your eligibility to participate in any promotion for any reason, in their sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous promotion in good faith. This Promotion is void where prohibited by law. Limit of one (1) Entry in this Promotion. 

8. Wagering Requirements 

See Section 4 above.  

9. Order of Funds Used for Wagering 

FanDuel Site Credit is used before deposited funds when wagering.

10. Eligible Games 

Only the “Tourney Shuffle’Em Contest” available during the Promotion Period on FanDuel Sportsbook or Daily Fantasy Sports is available for a chance to win a Prize. 

11. Restrictions on Withdrawal 

Prizes are not transferable and cannot be substituted except in Sponsor’s sole discretion. Prizes may only be used for wagering on your Sportsbook Account or entering contests on your DFS Account. Any unused portion of the Prize will be automatically withdrawn from your Sportsbook Account seven (7) days after being credited to your Sportsbook Account or will be automatically withdrawn from your DFS Account fourteen (14) days after being credited to your DFS Account. Deposited funds that have not been played may be refunded at any time.

In order to withdraw any winnings generated from wagers placed using your Prize from your Sportsbook Account, you  must make a minimum deposit of ten dollars ($10) into your Sportsbook Account. In order to withdraw any winnings generated from contests entered into using your Prize from your DFS Account, you must make a minimum deposit of one dollar ($1) into your DFS Account. Deposited funds that have not been played may be refunded at any time. Prizes  made to Sportsbook Accounts are in non-withdrawable site credit but do not carry any restrictions as to withdrawing winnings earned from use of such site credit. Promotion participants located in states that Sponsor does not offer a Daily Fantasy Sports or online Sportsbook service may contact customer support at https://support.fanduel.com to convert their Prize, if any, into withdrawable cash. DFS Accounts and Sportsbook Accounts associated with users located in states in which Sponsor currently offers a Daily Fantasy Sports or online Sportsbook service are not eligible to have any received Prize converted to withdrawable cash. 

12. Cancellation 

Should you wish to cancel your participation in this Promotion at any time, please contact customer support at https://support.fanduel.com/s. Upon cancellation, you may withdraw any funds (if applicable) you have deposited into your Sportsbook Account or DFS Account in connection with this Promotion without restriction. However, any FanDuel Site Credit in your Sportsbook Account or DFS Account  may not be withdrawn. For customers located in New York, complaints may be filed with the New York State Gaming Commission.

14. Additional Terms 

Publicity: I agree that if I am selected as the Winner of this Promotion, I will speak with any media personnel at Sponsor’s request and will participate in a specified number of other hours of any Sponsor-related marketing activities (at Sponsor’s discretion), such as participating in marketing photo shoots or interviews with the media. Subject to applicable law, Winners irrevocably grant the Promotion Parties and each of their licensees, and its and their successors, assigns and sub-licensees the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Promotion, in all forms of media and by any and all means and media (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration, except for the awarding of the Prizes to the Winners. By participating in the Promotion, Winners agree to refrain from any behavior or communication that would harm the image or reputation of the Promotion Entities or the FanDuel user community. I grant Sponsor ownership of any copyright or other rights I may have in the foregoing. I waive any right that I may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection with the foregoing or my name or the use to which they may be applied. I acknowledge and agree that in the event I violate or do not abide by these Official Rules, I will no longer be eligible to win this Promotion and Sponsor shall have the right in its sole discretion to select a different Winner. 

Suspension/Modification/Termination: Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent. Administration of this Promotion is at the sole discretion of Sponsor. Sponsor reserves the right to restrict at any time any person from participating in this Promotion for any reason. In the event Sponsor is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Promotion or Prizes. Sponsor additionally reserves the right, in its sole and absolute discretion: (i) to modify, suspend or terminate the Promotion should a Force Majeure event or occurrence corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (ii) to disqualify any entrant found to be, or suspected of: (a) tampering with the entry process or the operation of the Promotion; (b) acting in violation of these Official Rules; or (c) acting in an un-sportsmanlike manner.

Any questions relating to eligibility, these Official Rules or any other questions concerning this Promotion will be resolved at the sole discretion of Sponsor and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships or organizations may reproduce or distribute any portion of these Official Rules to their members.

Release and Waiver of Liability:  By participating this Promotion, participants agree to release, defend, indemnify and hold harmless the Promotion Entities and each of their directors, officers, employees, representatives and agents (collectively, the “Released Parties”) from and against any and all liability claims, actions, costs (including attorneys’ fees) of any kind whatsoever (however named or described) for injuries, death, damages or losses in connection with: (i) your participation in the Promotion; (ii) the receipt, use or misuse of any Prize, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by Sponsor’s own negligence; (iii) compliance with any of the FanDuel platforms’ terms of service, code of conduct or similar terms and conditions; (iv) the Released Parties’ actual or alleged violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or claims of infringement of intellectual property or other rights; and (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Promotion activity or Prize. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of any Prize. 

No Third-Party Sponsor: This Promotion is in no way sponsored, endorsed, or administered by, or in association with any person or other entity, including any third party, other than FanDuel. All questions regarding the Promotion must be directed to Sponsor. You agree as a condition of participating in the Promotion that you shall release any third party from any and all liability arising out of or relating to your participation in the Promotion, acceptance, use, or misuse of any Prize.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants and Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution:  You agree that any claim or dispute that has arisen or may arise relating in any way to or arising out of the Promotion or these Official Rules will be resolved in accordance with the dispute resolution provisions set forth in the “Binding arbitration and class action waiver” Section of the FanDuel Terms of Use (https://www.fanduel.com/terms). This Section of the FanDuel Terms of Use requires you to resolve disputes by binding arbitration and you agree to waive the ability to bring claims in a class action format.  

LIMITATION OF LIABILITY: BY ENTERING THIS PROMOTION, ENTRANTS AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION OR ANY PRIZE AWARDED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (II) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (III) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (IV) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

Entry Information and Promotion Communications: As a condition of entering the Promotion, each entrant gives consent for Sponsor to obtain and deliver their name, address and other information to third parties for the purpose of administering this Promotion and to comply with applicable laws, regulations and rules. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Promotion or on a Promotion Winners list. As stated, by participating in the Promotion, participant consents to all of the terms and conditions of FanDuel’s Privacy Policy, which is available at https://www.fanduel.com/privacy. In the event of any discrepancy between FanDuel’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.

Winners List: To receive any legally required list of the names of the Winners, send a self-addressed, stamped envelope, within sixty (60) days of the end of the Promotion Period, to: “Tourney Shuffle’Em Sweepstakes Winners List,” Betfair Interactive US LLC, Attn: Legal Department, 300 Park Avenue South, 14th Floor, New York, NY 10010. Please be sure to indicate which Promotion Winners list you are requesting by referencing the name of the Promotion in your request.

Miscellaneous: No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.
